Όροι Χρήσης Ηλεκτρονικού καταστήματος TA PANDA.

The use of electronic pages and services www.tapanda1.gr από τον επισκέπτη προϋποθέτει την ανεπιφύλακτη συμφωνία του με τους παρακάτω όρους χρήσης, που ισχύουν για το σύνολο του περιεχομένου, που περιλαμβάνεται στην ιστοσελίδα της. Συνεπώς, ο επισκέπτης οφείλει να διαβάσει προσεκτικά τους όρους αυτούς πριν από τη χρήση των υπηρεσιών του δικτυακού τόπου και εάν δεν συμφωνεί, οφείλει να μην κάνει χρήση των υπηρεσιών και του περιεχομένου τους. • Εκτέλεση σύμβασης: Προκειμένου να επιτευχθούν οι σκοποί της παρούσας σύμβασης δηλαδή να μπορεί ο πελάτης να ολοκληρώνει τις παραγγελίες του στο www.tapanda1.gr είναι απαραίτητη η επεξεργασία των προσωπικών δεδομένων που παρέχονται από τον πελάτη κατά την καταχώριση της παραγγελίας του στην φόρμα καταχώρισης της παραγγελίας και η καταγραφή των συναλλαγών του. Σκοπός της βασικής αυτής επεξεργασίας των δεδομένων είναι η ολοκλήρωση της συγκεκριμένης παραγγελίας, η επικοινωνία με τον πελάτη και η αποστολή πληροφοριακών μηνυμάτων που αφορούν τα στάδια της διεκπεραίωσης της παραγγελίας, η παροχή διευκρινίσεων σχετικών με την παραγγελία και γενικώς οι πληροφορίες για αγορές που έχει πραγματοποιήσει, η παράδοση της παραγγελίας στο χώρο επιλογής του πελάτη, η επιβεβαίωση και ταυτοποίηση του πελάτη σε κάθε αναγκαία περίπτωση και η ενημέρωση για το υπάρχον απόθεμα στο www.tapanda1.gr. Η ενημέρωση αυτή μπορεί να περιλαμβάνει ενημέρωση για τα προϊόντα της ή/και προσφορές ή/και διαγωνισμούς, την επικοινωνία για την διεξαγωγή ερευνώνγια τη βελτίωση των παρεχόμενων προϊόντων και υπηρεσιών της προς τα μέλη της καθώς και άλλες προωθητικές ενέργειες της και την εξυπηρέτηση παρόμοιων σκοπών.
• Έννομα συμφέροντα: Κάποιας μορφής επεξεργασία των προσωπικών δεδομένων είναι απαραίτητη για την βελτίωση των υπηρεσιών του TA PANTA 1 (επεξεργασία στατιστικών και μη ταυτοποιήσιμων δεδομένων), τον εντοπισμό προσπάθειας απάτης ή κακής χρήσης από το μέλος καθώς επίσης και για τη διαφύλαξη των έννομων συμφερόντων του TA PANTA 1.

1. Τα προσωπικά δεδομένα του πελάτη θα διατηρηθούν στα αρχεία του TA PANTA 1 για τριάντα (30) ημέρες από την ολοκλήρωση και την παράδοση της συγκεκριμένης παραγγελίας του και η επεξεργασία τους θα αφορά αποκλειστικά και μόνο την εκτέλεση της σύμβασης πώλησης από απόσταση. Τα δεδομένα όμως που αποδεικνύουν την πραγματοποίηση της συναλλαγής θα διατηρηθούν για φορολογικούς λόγους (παραστατικό τιμολόγησης).
2. Type Of Personal Data

Ειδικότερα τα προσωπικά δεδομένα που θα πρέπει να παρέχει κάθε πελάτης προκειμένου να διενεργηθεί οποιαδήποτε συναλλαγή μέσω του ηλεκτρονικού καταστήματος (www.tapanda1.gr)  και να πραγματοποιηθούν παραγγελίες προϊόντων του καταστήματος είναι τα εξής:

Το είδος των προσωπικών δεδομένων που επεξεργάζεται το TA PANTA 1 ανά σκοπό επεξεργασίας είναι τα εξής:

1. Για την εκτέλεση της σύμβασης (για να μπορεί, δηλαδή, ο πελάτης να ολοκληρώνει τις παραγγελίες του στο www.tapanda1.gr):

• full name
• the shipping address of the product
• the billing address of the order (if different from shipping address)
• the billing details (in case you chosen payment by invoice)
• the number of a contact phone
• the e-mail address (e-mail) of the user/client
• products purchased
• order history

The user is informed that the provision of such obligatory personal data as well as transaction data is necessary and is a prerequisite for the proper execution of the contract order and delivery of products and services. For this reason, it is not required the consent of the customer for this particular treatment.

2. Σε περίπτωση που ζητηθεί να γίνει παράδοση προϊόντων σε τρίτο πρόσωπο εκτός από τον χρήστη, ο τελευταίος αναγνωρίζει ότι θα έχει την πλήρη ευθύνη για την ενημέρωση και την πλήρη συναίνεση του προσώπου, που ορίζει ως παραλήπτη, για την κοινοποίηση των προσωπικών του δεδομένων στο κατάστημα TA PANTA 1για το σκοπό και μόνο της παράδοσης σε αυτό, των σχετικών προϊόντων και αναλαμβάνει πλήρως την ευθύνη για τυχόν αξιώσεις του προσώπου αυτού έναντι του TA PANTA 1.

4. Ο πελάτης ενημερώνεται επίσης ότι για την επικοινωνία TA PANDA 1 με αυτόν, στο πλαίσιο του άρθρου 11 παρ. 3 του ν. 3471/2006, επεξεργάζεται τα στοιχεία επικοινωνίας που αυτός έχει δηλώσει. Επίσης, όταν αποστέλλονται μέσω SMS/viber/email κλπ στον πελάτη ενημερώσεις για αλλαγές των όρων χρήσης του www.myhomestores.gr με υπερσύνδεσμο (link), είναι δυνατό να καταγράφεται η IP διεύθυνση της ηλεκτρονικής του συσκευής (κινητό, tablet, υπολογιστής κλπ) για την απόδειξη ότι το μέλος έχει λάβει την ενημέρωση.
5. Αποδέκτες δεδομένων: Για τα δεδομένα που είναι αναγκαία για την εξυπηρέτηση καθενός από τους ανωτέρω σκοπούς επεξεργασίας και στο πλαίσιο των αρμοδιοτήτων κάθε αποδέκτη, οι αποδέκτες των δεδομένων του πελάτη δύνανται να είναι:

Εξωτερικοί συνεργάτες που παρέχουν υπηρεσίες διαδικτύου, αποθήκευση και διαχείριση παραγγελιών, υπηρεσίες τηλεφωνικού κέντρου, υπηρεσίας ταχυμεταφοράς ή ομαδικής αποστολής προϊόντων, υπηρεσίες εγκατάστασης προϊόντων και υπηρεσίες ανάλυσης δεδομένων πωλήσεων, πάροχοι υπηρεσιών διαδικτύου και ηλεκτρονικού εμπορίου και τηλεφωνικά κέντρα εξυπηρέτησης πελατών με τους οποίους συνεργάζεται το TA PANDA 1 και οι οποίοι υπόκεινται στους ειδικούς αυστηρούς όρους επεξεργασίας προσωπικών δεδομένων που έχουν συμφωνήσει με το TA PANDA 1 ως Υπεύθυνο Επεξεργασίας.

Κατά την καταχώριση των προσωπικών δεδομένων του πελάτη οι υπάλληλοί και προστηθέντες του TA PANDA 1 συμμορφώνονται πλήρως με τις διατάξεις του Ευρωπαϊκού Γενικού Κανονισμού 2016/679 για την Προστασία Δεδομένων καθώς και με την ισχύουσα ελληνική νομοθεσία και νομολογία σχετικά με την προστασία προσωπικών δεδομένων. Το TA PANDA 1 απαιτεί από τους υπαλλήλους του, τους συντηρητές της ιστοσελίδας του, καθώς και τους τρίτους συνεργάτες του να λαμβάνουν όλα τα αναγκαία τεχνικά και οργανωτικά μέτρα (συμπεριλαμβανομένων των κατάλληλων πολιτικών και διαδικασιών ώστε να αποτρέπουν την αποκάλυψη των προσωπικών δεδομένων των πελατών του που επεξεργάζονται και διαθέτουν και εφαρμόζουν διαδικασίες διαχείρισης και επεξεργασίας των προσωπικών δεδομένων κατά τρόπο που είναι σύννομος και τα προστατεύουν σύμφωνα με τον ΓΚΠΔ.).

4. Rights of data subject: Any client, as data subject may at any time exercise the rights, as provided for in the General Regulation on the Protection of Personal Data 679/2016 E.E. and in particular articles 12 to 23, and the national legislation, and in particular:

1. the right to information and access to the data processed by the TA PANDA 1
2. the right to the restriction of the processing of the data,
3. the right of correction or deletion of part or all (right to be forgotten) of the personal data,
4. the right to object, i.e. to object to the processing of their personal data, and
5. the right to portability of the data.

The above rights of the state can be exercised as follows:

Για το δικαίωμα φορητότητας των προσωπικών δεδομένων, το TA PANDA 1 παρέχει τη δυνατότητα στους πελάτες του www.tapanda1.gr να λάβουν τα προσωπικά τους δεδομένα ή/και να τα διαβιβάσουν σε άλλο υπεύθυνο επεξεργασίας στο μορφότυπο που θα υποδειχθεί από την αρμόδια εποπτική αρχή, υποβάλλοντας σχετικό αίτημα στην ηλεκτρονική διεύθυνση homestores93@gmail.com.

7. Υποχρέωση Διαφάνειας: Για οποιαδήποτε πληροφορία σχετικά με τα δεδομένα του καθώς και την επεξεργασία και προστασία τους ο πελάτης δύναται να απευθύνεται στον Υπεύθυνο Προστασίας Δεδομένων το TA PANDA 1 (Data Protection Officer) στο email homestores93@gmail.com και στην τηλεφωνική γραμμή 2461033958 και εφόσον δεν θεωρεί ότι ικανοποιείται από την απάντηση του ενημερώνεται ότι έχει δικαίωμα προσφυγής στην αρμόδια εποπτική αρχή (Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα, www.dpa.gr, Kifissias 1-3, T.K. 115 23, Athens, greece ).
8. Τεχνικά και Οργανωτικά μέτρα προστασίας: Το TA PANDA 1 οι εκτελούντες την επεξεργασία για λογαριασμό του και οι προστηθέντες του / βοηθοί εκπλήρωσης εφαρμόζουν τα κατάλληλα τεχνικά και οργανωτικά μέτρα για την, κατά το δυνατό, καλύτερη προστασία των προσωπικών δεδομένων ενάντια σε τυχαία ή παράνομη καταστροφή ή απώλεια, αλλοίωση, παράνομη γνωστοποίηση ή πρόσβαση σε αυτά και γενικά την παράνομη επεξεργασία τους (συμπεριλαμβανομένης της εξ αποστάσεως πρόσβαση) όπως και για την διασφάλιση της δυνατότητας αποκατάστασης της διαθεσιμότητας και της πρόσβασης σε αυτά. Αυτά τα μέτρα στόχο έχουν να διασφαλίζουν ένα επίπεδο ασφαλείας που ανταποκρίνεται στον κίνδυνο που μπορεί να διατρέξουν τα συγκεκριμένα δεδομένα, λαμβάνοντας πάντα υπόψη το είδος και την κρισιμότητα των δεδομένων, την εξέλιξη της τεχνολογίας, το κόστος εφαρμογής και τη φύση, το πεδίο εφαρμογής, το πλαίσιο και τους σκοπούς κάθε συγκεκριμένης επεξεργασίας, εφαρμόζοντας παράλληλα διαδικασίες για την τακτική δοκιμή, εκτίμηση και αξιολόγηση της αποτελεσματικότητας των τεχνικών και των οργανωτικών αυτών μέτρων. Σε κάθε περίπτωση το TA PANDA 1 οι εκτελούντες την επεξεργασία για λογαριασμό του και οι προστηθέντες του / βοηθοί εκπλήρωσης δεσμεύονται να διατηρούν το απόρρητο των προσωπικών δεδομένων των πελατών και να μην τα κοινοποιούν ή επιτρέπουν την πρόσβαση σε αυτά σε οποιοδήποτε τρίτο μέρος χωρίς την προηγούμενη ενημέρωση του πελάτη εκτός από τις περιπτώσεις που ρητά προβλέπονται από τον νόμο.

6. ORDER OF PRODUCTS AND CONSUMER PROTECTION

Οι παραγγελίες μέσω του ηλεκτρονικού καταστήματος www.tapanda1.gr αποτελούν συνάψεις σύμβασης πωλήσεως εξ αποστάσεως, οι οποίες διέπονται από το νομοθετικό πλαίσιο του Ν. 2251/1994 (όπως αυτός ισχύει σήμερα) και των τροποποιήσεων που αναφέρονται στο ΠΔ 131/2003 (ΦΕΚ Α’ 116/16.05.2003) και την Απόφαση 31619 ΦΕΚ 969/22.3.2017 καθώς και της προσαρμογής της Ελληνικής νομοθεσίας προς την Οδηγία 2011/83/ΕΕ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 25ης Οκτωβρίου 2011, σχετικά με τα δικαιώματα των καταναλωτών, τη τροποποίηση της οδηγίας 93/13/ΕΟΚ του Συμβουλίου και της οδηγίας 1999/44/ ΕΚ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου και τη κατάργηση της οδηγίας 85/577/ΕΟΚ του Συμβουλίου και της οδηγίας 97/7/ΕΚ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου, η οποία δημοσιεύθηκε στην Επίσημη Εφημερίδα της Ευρωπαϊκής Ένωσης, με αριθμό L 304 της 22.11.2011 όπως αυτή τέθηκε σε ισχύ από την 13/06/2014.

Ο χρήστης έχει δικαίωμα σύναψης έγκυρης παραγγελίας μέσω του ηλεκτρονικού καταστήματος, εφόσον είναι δικαιοπρακτικά ικανός τηρώντας τις διατάξεις του Ελληνικού Αστικού Κώδικα (εφόσον έχει συμπληρώσει το δέκατο όγδοο έτος ηλικίας και δε τελεί σε δικαστική συμπαράσταση ως προς τη σύναψη σύμβασης πώλησης). Παραγγελίες μπορούν επίσης να πραγματοποιηθούν από νόμιμους εκπροσώπους νομικών προσώπων. Το HOME STORES, επιφυλάσσεται του δικαιώματος να αξιώσει την επιστροφή από τον εποπτεύοντα ή κηδεμόνα τυχόν παραγγελιών που θα πραγματοποιηθούν από δικαιοπρακτικά ανίκανα πρόσωπα. Σημειώνεται ότι οποιαδήποτε αγορά ή παραγγελία με φυσική παρουσία σας σε κάποιο από τα καταστήματα που διαθέτουν προϊόντα μας δε διέπεται από τους παρόντες όρους, αλλά από τους ισχύοντες όρους λιανικής πώλησης εκάστοτε καταστήματος.

To continue shopping, select from the main menu, which contains the next item you want and add it also in your cart. When you complete the process of adding products, press the button "shopping Cart" in the upper right part of your screen.

Ordering Process

The order is completed in 3 steps.

In the 1st step of entering on the form to "shopping cart" you will be asked the Postal Code of the destination address of your purchases in order to make an accurate calculation of your shipping costs.

At this point you have the option to pick up your order at home or by a specific focal points for the receipt of your area (where available). This is necessary before you lead us to the next step. After you calculate the shipping cost press the key, which leads us to the 2nd step.

In the 2nd step you will be asked to enter all the necessary data for the completion of your order.

In the 3rd step you will be asked for all the details on the pricing: (a) if you wish a receipt or invoice (b) all the details about the pricing, details and billing address, as well as information and shipping address if it is different from that of the billing.

Also select the method of Payment. Here you are given the option to choose to pay using 1) Credit card 2) through PayPal, or 3) through cash on delivery

Depending on the payment method you choose, your "loads" and the corresponding shape.

For the completion of your order, you will be prompted to accept the terms of use, which we recommend you read before you complete your order by pressing the key . You have the opportunity to do one last check of your order before you proceed to completion.

During the progress of your order, you can visit the section “my orders” in order to be informed about the progress of your order. The stages of progress of order is the following:

“Order” means The order has been registered.

“Send order”: The goods ordered have been collected and have been in the pipeline for shipment to your location.

Order cancellation

The return request shall enter into force from the date on which you tell us of the intention of returning the goods.

If the carrier/courier consider that the receipt of the products by the space that would indicate, can cause damage to your property, you will be informed orally and recorded in the form of receipt.
